Terms of Service

These Terms of Service ("Terms") govern your use of Candidate Falcon, a subscription-based career assessment preparation platform operated by Candidate Falcon ("we," "us," or "our"). By accessing or using the Service ("Service", or "Services"), you agree to these Terms. If you do not agree, please stop using the Service.
1. Acceptance of Terms
By creating an account, subscribing to a plan, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you confirm that you have the authority to bind that organisation to these Terms.
2. Description of Service
Candidate Falcon is a technology-enabled online platform that provides educational, informational, and preparatory services designed to help users prepare for employment-related assessments, interviews, screening processes, and other evaluation formats used in recruitment and hiring.
The Services includes, without limitation, practice environments, simulations, mock assessments, interview preparation tools, training exercises, question libraries, educational materials, feedback tools, performance insights, user-generated or user-stored content features, and related software, content, functionality, and support services made available through the Candidate Falcon website, applications, or associated platforms.
The Services can be offered in relation to general assessment categories or specific third-party assessment formats, providers, technologies, or interview platforms, whether now existing or introduced in the future.
The Services include all current and future products, tools, modules, content, features, functionalities, and access rights that we make available under the Candidate Falcon brand, whether on a paid, subscription, trial, promotional, beta, limited, or free basis.
3. Eligibility
The Service is available to users globally. To use the Service, you must have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
By using the Service, you represent and warrant that you meet this requirement. If you do not, please do not use the Service.
4. Account Registration and Security
To access the certain free and/or paid Services, you must create an account. When you register, you agree to:
- Provide accurate, current, and complete registration information and keep your account details up to date.
- Keep your login credentials confidential and not share your account with any other person.
- Accept full responsibility for all activity that occurs under your account.
- Notify us immediately at hi@candidatefalcon.com if you become aware of any unauthorised access to or use of your account.
We reserve the right to suspend or terminate accounts that we reasonably believe have been shared, misused, or accessed without authorisation.
5. Subscription and Payment
Access to some of the Services requires a paid subscription. Subscription plans and current fees are listed on our Pricing page available at candidatefalcon.com/pricing. By subscribing, you authorise us to charge the applicable fees to your chosen payment method.
Auto-Renewal: Subscriptions renew automatically at the end of each billing period at the then-current rate, unless you cancel before the renewal date.
Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription remains active until the end of the current billing period, after which access will cease. No partial-period refunds are provided upon cancellation.
Refunds: All fees and payments are non-refundable except as expressly provided in the Refund Policy available at candidatefalcon.com/refund-policy.
6. Acceptable Use
You agree to use the Service only for lawful, personal, and non-competitive purposes and in accordance with these Terms. You agree not to:
- Share your account credentials or allow any other person to access the Service using your account.
- Scrape, crawl, or use automated tools to extract, copy, or index any content from the Service.
- Reverse engineer, decompile, or otherwise attempt to extract the source code or underlying models of any part of the Service, including AI features or assessment simulations.
- Manipulate, abuse, or circumvent any AI-generated features, feedback mechanisms, or scoring systems.
- Reproduce, distribute, resell, or sublicence any content, tools, or materials provided through the Service.
- Violate any applicable law or regulation.
- Interfere with or disrupt the Service or the infrastructure supporting it.
We reserve the right to suspend or terminate accounts that we reasonably believe have violated these Terms, without notice or liability.
7. Intellectual Property
All content and materials made available through the Service — including but not limited to text, graphics, simulations, game-based assessment exercises, video interview frameworks, question libraries, articles, strategy guides, software, and AI models — are the exclusive property of Candidate Falcon or its licensors and are protected by applicable intellectual property and proprietary rights laws.
Subject to your compliance with these Terms and maintenance of an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial career preparation purposes. No other rights are granted.
You may not copy, distribute, or create derivative works from any Service content without our prior written consent.
8. AI-Generated Content Disclaimer
Candidate Falcon uses AI-powered tools to generate practice feedback, performance summaries, and coaching suggestions.
AI-generated feedback may be inaccurate or incomplete. We make no representation or warranty that use of the Service will improve your performance in any real assessment or lead to any employment outcome.
9. User-Generated Content
The Service allows you to upload and store content such as your resume and practice video recordings ("User Content"). You retain full ownership of your User Content.
By uploading User Content, you grant us a limited, non-exclusive, revocable licence to store, process, and use your User Content solely to provide the Service to you.
We will not share your User Content — including your resume or practice recordings — with third parties, except where required by law or where necessary to operate the Service.
We do not use your recordings or resume to train AI models.
10. Privacy
Your use of the Service is subject to our Privacy Policy at /privacy-policy, which is incorporated into these Terms by reference.
The Privacy Policy describes how we collect, use, store, and protect your personal information.
By using the Service, you consent to the data practices described in the Privacy Policy.
11. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Practice simulations and AI feedback tools on Candidate Falcon are not official versions of any third-party assessment and are not guaranteed to perfectly and/or fully reflect the content, format, or scoring of any real hiring assessment. We do not guarantee that use of the Service will result in success in any assessment or hiring process.
We do not warrant that the Service will be uninterrupted, secure, or error-free.
This content is provided for practice and informational purposes only. It does not constitute professional career or legal advice and does not guarantee any particular result in a real hiring process.
The simulations and practice exercises on Candidate Falcon are independent preparation tools and are not official assessments. Candidate Falcon is not affiliated with or endorsed by any assessment provider or employer. These third-party names are referenced solely to identify the types of assessments that users may encounter during real hiring processes and to help users choose the most relevant part of the Services we provide.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE TOTAL SUBSCRIPTION FEES YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION ARE A MATERIAL PART OF THESE TERMS. IF YOU DO NOT AGREE TO THESE LIMITATIONS, YOU MUST NOT ACCESS OR USE THE SERVICE.
13. Termination
You may cancel your account at any time through your account settings or by contacting us at hi@candidatefalcon.com. Cancellation does not entitle you to a refund of any prepaid fees except as expressly provided in our Refund Policy available at candidatefalcon.com/refund-policy.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other legitimate business reason. Upon termination, your right to use the Service ceases immediately.
Provisions that by their nature survive termination, including but not limited to provisions relating to intellectual property rights, disclaimers, and limitations of liability, will remain in effect after termination to the fullest extent permitted by applicable law.
14. Changes to Terms
We may update or modify these Terms from time to time, in our sole discretion. If we make material changes, we will always provide notice by posting the updated Terms on the Service, updating the "Effective Date" at the top of these Terms, and/or by sending you notice through the contact information associated with your account.
Any changes to these Terms will become effective upon posting, unless otherwise stated.
By continuing to access or use the Service after the updated Terms become effective, you agree to be bound by the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service.
You are responsible for reviewing these Terms periodically to remain informed of any updates.
